1. Acceptance of Terms

By purchasing or using Lume Scan software ("the Software"), you agree to these Terms of Service. If you do not agree, do not use the Software.

2. License Grant

Upon purchase, DarkWave Studios LLC ("we") grants you a non-exclusive, non-transferable, perpetual license to use Lume Scan on devices registered to your account. This is a software-only product. Hardware (OBD-II adapters) is purchased separately from third-party vendors.

3. Permitted Use

Personal, non-commercial vehicle diagnostics
Use with any compatible BLE OBD-II adapter on OBD-II compliant vehicles (1996+)
One license per individual; multi-vehicle use on one account is permitted

4. Restrictions

You may not reverse engineer, decompile, or modify the Software
You may not redistribute, resell, or sublicense the Software
You may not use the Software for commercial fleet operations without a fleet license

5. Disclaimer of Warranties

The Software is provided "AS IS." Lume Scan provides diagnostic information and fuel coaching based on OBD-II data. It is NOT a substitute for professional mechanical inspection or repair. We do not guarantee accuracy of readings, fuel savings estimates, or predictive maintenance alerts. Always consult a qualified mechanic for vehicle repairs.

6. Limitation of Liability

DarkWave Studios LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising from use of the Software, including but not limited to vehicle damage, missed diagnostics, or inaccurate readings. Total liability is limited to the purchase price of the Software ($29.99).

7. Refund Policy

We offer a 30-day money-back guarantee from the date of purchase. To request a refund, contact support@lumeauto.tech with your order confirmation.

8. Data & Privacy

Vehicle diagnostic data is processed locally on your device. See our Privacy Policy for details on data collection and use.

9. Intellectual Property

Lume Scan, the diagnostic governance engine, and all related technology are the intellectual property of DarkWave Studios LLC. US Provisional Patent 64/032,339 pending.

10. Modifications

We may update these terms at any time. Continued use of the Software after changes constitutes acceptance. Material changes will be communicated via email.

11. Governing Law

These terms are governed by the laws of the State of Tennessee, United States. Any disputes shall be resolved in the courts of Davidson County, Tennessee.
